Daniel John Sams' case adjourned in Tamworth court for evidence after alleged hit-and-run on Manilla Road, Oxley Vale

Daniel John Sams, 37, fronted Tamworth Local Court earlier this week, charged with a hit-and-run which left a 27-year-old man in a coma in John Hunter Hospital.

The court heard evidence was still being compiled in the case.

"The brief is not compliant, there are some key things still outstanding," police prosecutor Sergeant Rob Baillie told the court.

He said essential items like medical records and footage from the cameras worn by police officers had not been provided yet.

The matter has been referred to the state prosecuting authority, the DPP. The case was adjourned to next month.

Sams is accused of being behind the wheel of a Toyota Echo when it hit the man and a 28-year-old woman as they walked along the edge of Manilla Road in Oxley Vale at about 11:30pm on January 8.

The police case is Sams then fled the scene.

The man was treated for serious head injuries, though the woman was not badly hurt.

Police set up a crime scene and said they found the Echo abandoned nearby before officers homed in on Sams.

Sams remains on strict bail conditions including not to drink alcohol and not to drive.

He has not yet entered pleas to allegations of dangerous driving causing grievous bodily harm (GBH) while under the influence, causing bodily harm by misconduct while in charge of a vehicle, and failing to assist after a crash causing GBH.

He is also charged with two counts of negligent driving and driving under the influence of alcohol.
