Senior Constable Aaron Luke Unicomb's case was set for hearing last week at Armidale Local Court.
Instead, court documents show magistrate Roger Prowse dismissed all charges against Mr Unicomb, after an objection to evidence was upheld and it was excluded from the case.
Mr Unicomb's defence solicitor Lucas Swan said the rules should apply to everyone.
"It doesn't matter whether you are a police officer or not, if you are subject to investigation on criminal allegations, senior members of NSW Police should know the rules about suspect's rights," he said.
"In particular their right to obtain legal representation, they did not do that and they should know better."

Mr Unicomb faced three counts of failure to notify police about supply, loss or theft of a firearm; holder of a licence not have approved storage; possession or attempt to possess an anabolic or androgenic steroid and possession or attempt to possess a prescribed restricted substance.
He pleaded not guilty to all charges and has applied to have the costs of his legal battle reimbursed.
Mr Unicomb was charged two weeks after police raided his home in mid-February and an internal investigation launched. He first fronted court in April when police confirmed his employment was under review.
A NSW Police spokeswoman said an employment decision hasn't been made.
"A police officer attached to New England Police District is subject to an internal investigation," she said.
