A CHARGE has been withdrawn against one of the men accused of firing a gun at police during a pursuit in Tamworth.

Joshua Tehoata appeared in Tamworth Local Court via video link on Wednesday from Clarence Correctional Centre where he remains behind bars.
Solicitor for the state prosecuting authority, the DPP, Cat McKay, confirmed the charges against Tehoata that will progress to the district court.
Those charges include discharging a firearm with intent to resist arrest; three counts of possessing a shortened firearm; possession of a prohibited weapon as well as related charges of possessing ammunition; custody of a knife in a public place and possessing a prohibited weapon.
A charge of drug possession was withdrawn.
Magistrate Julie Soars said Tehoata will come in via video link on the next occasion.
Tehoata didn't apply for bail and it was formally refused.
"The prosecutor has given your lawyer a charge certificate which shows all the offences the prosecutor intends to proceed with, if you case goes to trial in the district court," she said.
Police allege the pair fired a gun at officers amid a dramatic car chase through the city that ended when the Ford the pair were travelling in lost control and crashed through a gate at Tamworth Golf Course.
It's the police case that the passenger of the Ford leant out the window and fired a gun at police as the chase wound its way through Nemingha, Kootingal, Calala and Tamworth.

Tehoata's co-accused Tyson Booby also had his case called on Wednesday.
It's the police case that the pair tried to run away before they were arrested on the course a short time later.
Police claim several bullet holes were discovered in the bonnet of the police car.
Booby's matter is set for a case conference before he returned for committal in December.
He made no application for bail and it was formally refused.
He is yet to enter any pleas.
