David John Wells fronts court, accused of May 21 fatal crash on Old Ballandean and Mount Lindesay Roads, Tenterfield

Police allege David John Wells was under the influence when he caused a crash that claimed the life of his passenger in Tenterfield on the afternoon of May 21.

It's the police case that 23-year-old Wells was behind the wheel of a Ford Laser when he collided with a truck at the intersection of Old Ballandean and Mount Lindesay Roads, just before 5pm.

The 59-year-old woman, who was a passenger of Wells, died at the scene after the car rolled.

Wells was taken to Tenterfield hospital for his injuries and mandatory testing after the crash, while the 41-year-old woman driving the truck escaped injury. She was also taken to hospital for mandatory testing.

New England police set up a crime scene at the crash site which was examined by forensic police.

The Far North Coast Crash Investigation Unit took charge of the crash probe.

Officers investigating the fatal then arrested and charged Wells on October 2 at Casino Police Station.

He's facing charges of dangerous driving occasioning death while driving under the influence; negligent driving occasioning death; negligent driving; driving under the influence of drugs; driving with an illicit drug present in blood; and not give way.

In Casino Local Court last week, Wells was not required to enter pleas to the charges.

Magistrate Kathy Crittenden ordered police to compile a brief of evidence into the case, which will return to court in mid-January. Wells remains on conditional bail.
