THE PRISONER who allegedly used a toilet break in hospital to run from officers has pleaded not guilty to escaping police custody.

A lawyer for the accused, Jet Fitzroy, also entered a plea of not guilty to a driving under the influence of alcohol charge in Tamworth Local Court on Monday.
The 24-year-old is yet to enter a plea to possession of prohibited drugs and having suspected stolen goods.
Magistrate Julie Soars considered a six week adjournment but had concerns about police availability in the Christmas period.
Police prosecutor Cynthia Donovan told the court the adjournment to compile the brief of evidence would be no issue.
"Your Honour, police work 24-hours, six days a week over Christmas," she said.
"At country music time there's a leave embargo."
Police allege Fitzroy broke free from a police officer's grasp while receiving hospital treatment, about 7:40am on October 7.

Fitzroy will return to court in January next year for a hearing.
