Fraud accused: Justin Luke Yianakis taken to hospital for treatment

Justin Luke Yianakis, 40, did not appear in Tamworth Local Court on Wednesday.

Defence solicitor Gary Johnston told the court his client could not post surety to have his bail conditions changed.

"This [variation] allows him to go to hospital and not have to report to Gunnedah police, because he's actually in Newcastle," Mr Johnston said.

"His last conditions were to reside somewhere in Newcastle, but he's become unwell enough again to warrant full-time admission back into hospital."

Police prosecutor Rob Baillie supported the bail variation and asked for the matter to be adjourned for charge certification.

"The DPP advise asking for a ten week process for charge certification, that's because of the quantum of documents to look at in this matter," he said.

"It's slightly longer than normal."

Yianakis faces a slew of 67 fraud-related charges, including 35 for dishonestly obtaining financial advantage by deception, publishing false or misleading material to obtain an advantage, dealing with identity information to commit an indictable offence, knowingly deal with proceeds of crime and dishonestly obtaining property by deception.

He is yet to enter a plea to any of the charges.

In May, Magistrate Julie Soars granted Yianakis bail to obtain treatment at Toronto Hospital on the strict conditions he be of good behaviour, have no access to a mobile phone, the internet, or go to any international point of departure.

He is not allowed to communicate with any Crown witnesses except through his lawyer.

The matter will return to court in October for charge certification.

He is excused on the next occasion if legally represented and still in hospital.
