Aubrey Michael Flick, is being held in custody in the maximum security wing of Cessnock jail and appeared via video link in Tamworth Local Court on Wednesday morning.
“We have received a copy of the brief of evidence,” Legal Aid solicitor Rae Parker told the court.
“It’s not complete … in the sense there is no … medical evidence of the injury at this stage.”
Flick is charged with the attempted murder of a 38-year-old man in Sue Cr, Coledale, on August 17.
Police allege Flick stabbed the man in excess of 20 times in the torso, shoulder, hands and leg areas.
The alleged victim of the stabbing has since been released from hospital.
Flick is also facing a charge of assaulting a police officer during his arrest, shortly after the alleged incident.
He is yet to enter a plea to the charges.
Ms Parker said she had tried to visit her client in prison in Tamworth in a prearranged meeting before he was unexpectedly moved to Cessnock by Corrective Services.
“He would like to see the brief,” she said, adding she had conferenced her client this week and had now sent the brief to the Cessnock prison.
“He hasn’t received a copy of that paperwork yet.”
Ms Parker said the public defender had been briefed on the case and it could resolve if an adjournment was granted.
“I think the matter could resolve potentially for sentence on the next occasion,” she said.
The court heard a fresh count of causing wounding to a person with intent to murder was laid at court on Tuesday.
“Sequence three served in court,” Magistrate Roger Prowse said, examining the court papers.
Mr Prowse adjourned the case for one month to allow Flick’s legal team to consider the fresh charge.
Flick made no application for bail on Wednesday and it was formally refused.
